AGREEMENT OF TERMS AND CONDITIONS FOR SOFTPIXEL
READ THIS CAREFULLY — IT AFFECTS YOUR RIGHTS AND HOW YOU USE SOFTPIXEL. These terms and conditions (the "Agreement") control how you use Softpixel.space ("the Company") and access our platform, community galleries, animation tools, and related services ("the Service"). The Service includes all content, features, artwork, animations, code, documentation, community tools, and intellectual property tied to Softpixel—copyrights, trademarks, and all other proprietary rights. By using the Service, you confirm that you're at least 13 years old, you understand and agree to these Terms of Service, and if you're between 13 and 18, your legal guardian has reviewed and consents to these terms. This is a binding legal agreement between you and Softpixel. You get a limited personal license to use the Service by agreeing to these terms. Break this Agreement and your license ends immediately—you have to stop using the Service. The license is yours alone and only for engaging with our pixel art community. When these terms change, Softpixel will post updates on our website. Keep using it and you accept the changes. You can't modify this Agreement. Only Softpixel can make changes in writing. Softpixel reserves the right to modify, remove, or add terms anytime by posting updates to our website. Changes take effect right away. Disagree with any current or updated terms? Your license terminates and you must stop using the Service immediately.
USE OF SERVICE
You acknowledge that Softpixel owns the Service and all its content. Don't share, transfer, or distribute access to others. You won't reverse-engineer, decompile, modify, or alter the Service or try to extract its code or structure. You won't loan, rent, or lease your account or access to any third party. When using Softpixel, you agree to follow these rules: Don't disrupt, interfere with, or bypass any security features of the Service. Don't use the Service to violate any applicable law. Don't harm minors or reveal anyone's personal information. Don't impersonate others or misrepresent your identity or affiliation. Don't use cheats, bots, automation software, or tools designed to exploit the community. Don't defraud, mislead, or abuse other users or Softpixel. Don't engage in conduct that Softpixel deems harmful to the community or service. You agree to follow all applicable laws and regulations governing your online conduct. Any internet service fees, data charges, or mobile carrier costs you incur while accessing Softpixel are your responsibility. Softpixel decides what conduct violates these terms and reserves the right to take action, including removing your access to the Service.
PAYMENT AND WARRANTY
Purchase premium features or subscriptions and you agree to pay all charges promptly. Want a refund? You have seven days from purchase if the Service isn't performing as described. ALL SALES ARE FINAL AND NON-REFUNDABLE AFTER SEVEN DAYS, UNLESS SOFTPIXEL APPROVES A REFUND IN ITS SOLE DISCRETION. After the seven-day window closes, Softpixel continues providing support through our customer service team.
USER-GENERATED CONTENT
Softpixel lets you upload, share, and post animations, artwork, palette studies, timelapse videos, and other creative work ("Your Content"). You represent that Your Content is original, you own all rights to it, and you can grant Softpixel the rights described below without infringing on anyone else's rights. You grant Softpixel a worldwide, perpetual, royalty-free license to use, display, distribute, modify, and publicly share Your Content across the Service and in any marketing or promotional materials. You also grant Softpixel the right to sublicense these rights to other users and third parties. You waive any moral rights or attribution claims you may have regarding Your Content. Softpixel doesn't review, monitor, or moderate Your Content before it appears on the Service. You take all risks when sharing Your Content. Softpixel can remove, censor, disable, or modify any Your Content anytime without notice, for any reason. Your Content isn't confidential and won't be returned to you. Other users may view, comment on, and interact with Your Content. You're solely responsible for it and any consequences from sharing it. Softpixel disclaims all liability for Your Content and for any User Content created by other users on the Service.
SOFTPIXEL DISCLAIMERS
THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOFTPIXEL AND ITS AFFILIATES MAKE NO GUARANTEES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. TO THE FULLEST EXTENT PERMITTED BY LAW, SOFTPIXEL AND ITS PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. SOFTPIXEL'S LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO SOFTPIXEL IN THE 90 DAYS BEFORE YOUR CLAIM. IF YOU HAVE PAID NOTHING, YOUR SOLE REMEDY IS TO STOP USING THE SERVICE. Some jurisdictions restrict how much companies can limit liability, so some limitations above may not apply to you.
TERMINATION
Softpixel may terminate your access to the Service anytime for any reason, with or without notice. It may also suspend or remove your access if it suspects you've violated these terms or engaged in harmful, illegal, or abusive conduct. When your access ends, you lose everything—your content, uploads, account data, and any community contributions. You won't receive refunds, reimbursement, or compensation for any reason. Softpixel has no liability for data loss from termination. Softpixel reserves the right to refuse service to anyone at any time.
DISPUTES WITH OTHER USERS
Softpixel doesn't manage or resolve disputes between users. You're solely responsible for your interactions with other community members. Softpixel disclaims all liability for any disputes, conflicts, or issues arising from user-to-user contact or collaboration on the Service.
THIRD-PARTY LINKS
Softpixel may contain links to external websites or resources. Softpixel isn't responsible for the availability, accuracy, or content of third-party sites. Links don't imply endorsement. You assume all risk when visiting external websites. Softpixel may remove links anytime without notice.
GOVERNING LAW
These Terms of Service are governed by the laws of the United States. Both parties consent to the jurisdiction of the courts in the United States.
SUCCESSORS AND WAIVERS
These terms bind and benefit both parties and their heirs, agents, successors, and assigns. You can't assign these terms without Softpixel's written consent. Softpixel may assign these terms to any party that agrees to them. Any waiver of a provision must be made in writing and doesn't constitute a continuing waiver of any subsequent breach.
SEVERABILITY
If any portion of these terms is found invalid, the rest remains in full effect.
ENTIRE AGREEMENT
These Terms of Service are the complete agreement between you and Softpixel regarding your use of the Service.
